Citizen Files Lawsuit Against Texas State

Secretary of State

Jody Brockhausen Requests The Secretary of State to VERIFY  "Natural Born Citizen" Status of  Barack Obama Prior to Election Day - Serious Questions Remain

Filed: Williamson County District Court Monday, Oct. 27, 2008

Served: via Travis County Constable on October 28, 2008 at 1:51PM

On September 24, 2008 rather than provide a certified 'vault' copy of his birth certificate to the Court, Barack Obama utilized the resources of  three lawfirms to represent him in filing a "motion to dismiss."

Specific Document - Motion To Dismiss By Barack Obama 9/24/08:

Specific Document - Judge Order To Dismiss: 10/27/08:

Complete Set of Philadelphia Court Documents:

Obama's motion to dismiss rather than provide the document casts serious public doubt on Barack Obama's 'natural born citizen status.  Obama chose to submit his motion at the last possible moment, and the public was required to wait until one week prior to Election Day for the judge to make his ruling.  While the case was dismissed on Oct. 27, 2008,  it was due to lack of standing by plaintiff, not lack of merit.  This case was observed closely by those interested in pursing the truth regarding Presidential Nominee Barack Obama's citizenship status.  If he is not a 'natural born citizen,' people want to know before  Nov. 4th.

The  Phil Burg Case has received excellent coverage in spite of some media outlets choosing to wait until the outcome of the case to report on it.  Phil Burg reports he his website obamacrimes.com  has received 71 million hits.  As this case has not been resolved in the eyes of the public, as no certified copy of Obama's birth certificate has been brought forth for scrutiny in a court of law, serious questions remain and the public wants to know the facts.  Is Obama a 'natural born citizen?'

This is an important question as it is one of the three requirements spelled out in the US Constitution:

1. "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President;"
2. "Neither shall any person be eligible to that office who shall not have attained to the age of thirty-five years," 3. "And been fourteen years a resident within the United States."
(United States Constitution, Article II, Section 1 )

The Texas Constitution states:

"To be eligible to be a candidate for, or elected or appointed to, a public elective office in this state, a person must:

Texas State Constitutional indicates it is the duty of the Secretary of State to oversee the Texas State Ballot"The secretary of state shall certify in writing for placement on the general election ballot the names of the candidates for president and vice-president who are entitled to have their names placed on the ballot."

Sec. 192.033. CERTIFICATION OF CANDIDATES FOR PLACEMENT ON BALLOT. (a) Except as provided by Subsection (c)

The Public has questions about the citizenship status of Presidential candidate Barack Obama.  Jody Brockhausen requests that the Secretary of State to fill the duty of her office by certifying that Mr. Obama 'eligible to be a candidate" on the Texas State Ballot.  Providing a Certified Copy of Barack Obama's birth certificate to a judge to review will work to satisfy the concerns of the American people as they enter the voting booth next Tuesday.

The fact that Obama refused to bring forward his birth certificate to verify his citizenship in the Philiadelphia court creates serious doubt in the minds of Texas citizens.  This matter is of particular importance knowing Obama was enrolled in a public school in Indonesia from age six to ten. We learn from Obama's website that he is "The son of a father from Kenya. " Go to: http://obama.senate.gov/news/060710-obama_trip_to_h/)

Being a natural born citizen is a legal requirement to run for the office of President, the voting public has a right to know if Obama is a natural born citizen.

It is interesting to note that the only requirement from the Federal Election Commission (FEC) is for the candidate for President to fill out these forms:

1. http://fec.gov/pdf/forms/fecfrm1.pdf

2. http://fec.gov/pdf/forms/fecfrm2.pdf.

Although no proof of citizenship required by the FEC, a firm warning appears at the bottom of the form:

" NOTE: Submission of false, erroneous, or incomplete information may subject the person signing this Statement to the penalties of  2 U.S.C. 437g.

See explaination: http://caselaw.lp.findlaw.com/casecode/uscodes/2/chapters/14/subchapters/i/sections/section_437g.ht ml

Providing a Certified Copy of Barack Obama's birth certificate to a judge to review will work to satisfy the concerns of the American people as they enter the voting booth next Tuesday.  As the Philadelphia courts failed to provide the public with the verification of a natural born citizenship status, a Round Rock citizen turns to the Williamson County Court to encourage the Secretary of State to provide answers about the candidate in question.
